Rules

Here are general rules for my artworks. For commissions rules and ToS, see here.

  • I don't do free art requests

  • Art trades and collaborations are only open for close friends/mutuals

  • Repost of my artworks will be only allowed with proper credits and linking source

  • You can use my artwork for profile, header/banner pictures, etc. on your social media (no need to ask).

  • Unauthorized commercial use of my artworks is prohibited

  • Tracing, recolors, and any other picture alteration (unless i'm okay with it) is prohibited. This doesn't include picture cropping, small color alterations and filters.

  • Claiming my artwork or characters as your property is prohibited

  • Using my artwork for offending/attacking certain people or groups is prohibited

  • Removing watermarks and signatures from my artworks is prohibited

  • My artworks can, should and will not be used for cryptocurrency, NFT and generative AI learning related businesses or uses.


Terms of Service (T.O.S)

You'll agree with the following Terms of Service by reading them and/or commissioning me.
For clarity, from this point on, the artist "jakisalt ★" will be referred to in first person ("I" or "me"), the client in second person ("you"), and your commission as "commissioned work or piece".


General info. about commission process

  • I (only) use PayPal as method of payment. If you're not requesting your commission from VGen, I'll send you an invoice, so I'll ask for your email to do this.

  • My commission process generally goes like this: payment > sketch > lineart > base colors > shading > background > final piece (this process may differ depending on the art style you'll request). I'll start working on the next phase after you had approved/are satisfied with an update or a change I made on the piece.

  • I only accept upfront payments before starting with the sketch. However, you can still ask for split payments (before sketch and after the final piece is done).

  • I'll give you updates and screen captures of your requested commission. I prefer using Discord, Twitter or e-mail to contact and message you, so please make sure to list your usernames/handles for any of these social media when requesting.

  • Price might increase depending on drawing difficulty/complexity. This includes details such as the design of the requested character(s) or poses.

  • If you want your commission to be for commercial use, please tell me beforehand.

  • If you want to set a deadline for your commission, please tell me before hand. If I consider a deadline too short to accomplish, I deserve the right to demand a rush fee, or to decline your request.

  • My turnaround time starts from 3 weeks, and it might extend depending on drawing difficulty/complexity, coloring/drawing style requested, another pending requests/commissions on my queue, or if there’s any personal/real life inconvenient. I'll try to keep you informed the more I can regarding your commission status or my availability conditions.

  • If you haven't received any messages from me and want an update, I suggest checking my Trello queue board to see general updates before sending a message.

  • I might not work on your commission on weekends (fridays, saturdays and sundays) during my college period.

  • If you want to remain anonymous or don't want your commissioned work to be public, please tell me beforehand.

  • Send visual references the more you can. Written references are okay, but I encourage trying to not entirely describing your request like this. I also suggest sending visual references that are precise, clear and easy to understand

  • Multiple variations of the final commissioned work will be sent via e-mail, Discord or a Google Drive folder link. These variations might be: no watermark version, no background version and watermarked version.

  • No refunds, unless I haven't started your commission yet and you'd like want to cancel before I start working, or I happen to not being able to work on your commission before starting lineart phase. I'll have to notify you in that case.

About what we (me and you) can and cannot do:

What I'll draw:

  • Humanoid characters

  • Original/Fan characters

  • Fanart

  • VTubers and other virtual characters

  • Fictional characters in general

  • Real life people with prior given consent (features of the person might be simplified in my art style).

  • Kemonomimi

  • Couples

  • Groups (up to 5 characters)

  • Selfshipping/Selfinserting/Yumeshipping

  • GL/BL/Straight couples

  • LGBTQA+ content, characters and ships

  • Non-explicit NSFW/Suggestive content (erotic actions, poses, shots, facial expressions, language and gestures are okay as long as isn't entirely R-18 content or showing genitalia. Keep it R-15)

  • Soft gore, bruises, blood, wounds and violence

  • Fetishes (please ask. I'm only comfortable towards a little amount of them)

  • Vent art (please ask)

  • Commercial, streaming, promoting and merchandise use art

What I won't draw:

  • Non-humanoid characters (chibi animals or creatures are okay)

  • Offensive content against certain people or groups/hate language or content

  • Explicit NSFW/R-18 content (not yet! heh)

  • Fetishes or sexual/suggestive content that may make me uncomfortable

  • Mecha (robotic parts and cyborg characters are okay, please ask)

  • Non-anthro animals

  • Complex backgrounds

  • NFT related use art

  • Any other content that might make me uncomfortable to work with, goes against my values and moral or isn't listed on the "What I'll draw" section.

What you can and cannot do:

  • You cannot use the final commissioned work for commercial use without permission (in other words, if you've requested a personal use commission). You can still ask me beforehand if you can use your commissioned work for these purposes (see "General info about commission process" above).

  • Besides me, only you will have the right to repost and use the final commissioned work giving correspondent credits and claim it for your personal use only, or commercial use with further advice, depending on the case. Credits are appreciated, but not needed.

  • You cannot claim intellectual property of your commissioned work/claim it as yours.

  • You cannot remove my watermarks or signatures from the final commissioned work.

  • You cannot redistribute or sell .psd or any other editable files.

  • You cannot trace or recolor your commissioned work.

  • And, of course, last but not less important; my final commissioned works can, should and will not be used for cryptocurrency/NFT related businesses, trades and uses, nor for AI training for picture generation.

About personal and commercial use:

Personal use:

I'll define a personal use commission as: "an unique product made for the client with the purpose of fulfilling their personal enjoyment; it will be exclusive, utilizable and non-profitable". If you have requested a personal use commission, you can:

  • Use your commissioned work publicly on social media. You can post it, use it as your profile, banner or header picture, etc. as long you're not using it for profit or advertisement purposes.

  • Use your commissioned work for personal merchandising such as stickers, prints, clothes, key chains and other tangible goods that will be for your exclusive use only. In other words, you cannot sell these goods.

  • Make small alterations and modifications to your commissioned work, such as cropping, using it for memes and templates, adding filters to it, etc. as long as it doesn't lose the original idea and you're not using it for profit or advertisement purposes.

  • Request the .psd and other editable files of your commissioned work for an extra fee (+50% of the original price).

  • You cannot claim intellectual property from your commissioned work.

  • You cannot use your commissioned work for NFTs, crypto currency, generative AI technologies and other related businesses and uses.

  • Anything else as long you're not profiting or making money from your commissioned work.

Commercial use:

I'll define a commercial use commission as: "an unique product made for a client, company, business, group of people or content creator with the purpose of achieving an economic benefit from the use, exploitation or commercialization of this product; it will be exclusive, utilizable, and profitable". The following cases and activities fall under this concept of commercial use:

  • Commissioned works for merchandising and tangible goods that will be sold in small or big amounts to a person or a group of people (e.g.: stickers and other merchandising to be sold in events or conventions).

  • Commissioned works for monetized and profitable videos and live streams. (e.g.: illustrations for thumbnails, "starting soon" screens and other graphics used for monetized live streams).

  • Commissioned works to build the brand and identity of an account, person or content creator who can profit and make money from their products and content (e.g.: Twitch and YouTube profile pictures for monetizing streamers)

  • Commissioned works for monetized and profitable songs, albums, LPs & EPs, singles, demos and other audible content (e.g.: cover art illustration for a musical album that will be uploaded to Spotify).

  • Commissioned works for profitable advertisements that will promote a product, brand, event, public figure, etc. (e.g.: illustration for a paid advertisement on Instagram to promote a product)

If you have requested a commercial use commission, you can:

  • First of all, take in mind you should state beforehand (while making your request) your commissioned work will be for commercial use. Commercial use fee starts from a +100% from the total price of your request. However, this amount can increase depending on what will you use your commissioned work for.

  • Only you (a single person or group of people), as client, will be authorized to make profit from this commissioned work.

  • You can use your commissioned work as many times as you want for profit purposes (such as the examples given above).

  • You can make small alterations and modifications to your commissioned work, such as cropping, using it for memes and templates, adding filters to it, using it for monetized posts on social media, etc.

  • You can receive a .psd or editable file for your exclusive use only. You cannot resell, redistribute or claim property of these files.

  • You cannot claim intellectual property from your commissioned work.

  • You cannot use (nor request) your commissioned work for hate and political discourses, or for topics that are against my values.

  • You cannot use your commissioned work for NFTs, crypto currency, generative AI technologies and other related businesses and uses.

  • Anything else, as long as you're the only person (or group of people) who will make profit from the commissioned work.
